Executive Summary

During the short period from September 1996 to March 1997 the following three EU Directives were adopted by the Council – the IPPC Directive, the Seveso II Directive and (amendments to) the EIA Directive. Member States, therefore, had to transpose three major instruments into their national legislation within two to three years. In addition, the IPPC Directive introduced a system that was new to many Member States. In considering how to facilitate the practical application of the IPPC Directive some Member States also have taken into account the EMAS Regulation.

Project description

The report of this project presents the results of an IMPEL ad hoc project with the regard to the issues above. It contains three main sections.

  1. section 1 is a comparison of the texts of the four instruments. It is intended to make reading the legal texts easier.
  2. section 2 lists the installations falling within the scope of the instruments. It is intended to give an indication of whether or not a particular installation has to comply with the provisions of one or more of the Directives, and indicates where EMAS is relevant.
  3. section 3 sets out the experience gained so far by Member States in the transposition and implementation of the EIA, IPPC, Seveso Directives and the EMAS Regulation.

Finally there are some preliminary conclusions for efficient implementation of the four instruments and on enhanced consistency between them, wherever relevant.
